ARCEP BENIN E-Services Platform

Article 1 - Purpose

These Terms and Conditions of Use (TCU) define the rules for using the E-Services platform provided by the Regulatory Authority for Electronic Communications and Posts of Benin (ARCEP BENIN).

The platform enables users to complete online administrative procedures related to the electronic communications and postal sectors. By accessing the platform, the user accepts these TCU without reservation.

Important : Use of the platform implies full and complete acceptance of these terms and conditions.

Article 2 - Services Offered

The services available on the E-Services platform include:

  • Approvals : telecommunications equipment, installers, testing laboratories
  • Networks and infrastructure : ISP, IoT, radio, satellite, fiber optic, MVNO/MVNE
  • Numbering resources : frequencies, short codes, USSD codes, VAS
  • Electronic services : cybercafés, telecenters, value-added services
  • Postal services : national and international delivery, express mail
  • Compliance : EMC control, site validation, interference complaints

Article 3 - Platform Access

Access to the E-Services platform is open to any individual or legal entity wishing to carry out procedures with ARCEP BENIN.

Some features require the creation of a user account. The user is responsible for the truthfulness and accuracy of the information provided during registration.

Warning : Any false statement may result in the rejection of the application and legal proceedings.

Article 4 - User Commitments

By using the platform, the user agrees to:

  • Use the platform in accordance with its intended purpose
  • Not compromise the security or proper functioning of the platform
  • Comply with the laws and regulations in force in Benin
  • Provide accurate and up-to-date information
  • Not attempt to access unauthorized areas

Article 5 - Personal Data Protection

Personal data collected is processed in accordance with Law No. 2017-20 of April 20, 2018 on the Digital Code in the Republic of Benin, particularly its provisions relating to the protection of personal data.

The user has the right to access, rectify, and delete their personal data.

Article 6 - Security

ARCEP BENIN implements appropriate technical and organizational measures to ensure the security and confidentiality of data.

The user is responsible for maintaining the confidentiality of their login credentials. They agree to immediately notify ARCEP BENIN of any unauthorized use of their account.

Article 7 - Intellectual Property

All content on the platform (texts, graphics, logos, icons, images, software) is protected by intellectual property rights.

Any reproduction, representation, modification, or reuse, in whole or in part, is prohibited without the prior written authorization of ARCEP BENIN.

Article 8 - Limitation of Liability

ARCEP BENIN strives to ensure the availability of the platform but cannot guarantee continuous and uninterrupted access.

ARCEP BENIN shall not be held liable for:

  • Temporary interruptions for maintenance or updates
  • Damages resulting from improper use of the platform
  • Data loss due to external causes

Article 9 - Amendments to the TCU

ARCEP BENIN reserves the right to modify these TCU at any time. Amendments take effect upon publication on the platform.

Users are advised to regularly consult the TCU to be aware of any amendments.

Article 10 - Applicable Law and Jurisdiction

These TCU are governed by Beninese law.

In case of dispute relating to the interpretation or execution of these terms, and failing amicable resolution, the competent courts of Cotonou (Republic of Benin) shall have sole jurisdiction.
